Guru Besar Hukum Undip Menilai Dakwah Khilafah yang Diusung HTI Bukan Tindakan Radikalisme
MUSTANIR.com – Meski pencabutan Badan Hukum Perkumpulan (BHP) Hizbut Tahrir Indonesia berkekuatan hukum tetap (inkracht) pasca Mahkamah Agung menolak kasasi ormas yang mendakwahkan kewajiban menegakkan khilafah tersebut, umat Islam tetap diperbolehkan mendakwahkan sistem pemerintahan Islam tersebut.
“Kembali pada konsep bahwa khilafah ajaran Islam atau setidaknya sebagai sistem pemerintahan Islam yang telah dikenal dan dipraktikkan selama 1300 tahun, maka umat Islam tanpa kecuali tetap diperbolehkan ‘mendakwahkan’ ajaran Islam itu dengan catatan: tidak boleh ada pemaksaan dan penggunaan kekerasan,” ungkap Guru Besar Fakultas Hukum UNDIP Prof. Dr. Suteki, S.H., M.Hum. Seperti dikutip dari mediaumat.news, Sabtu (23/2).
Saat ditanya apakah rezim sekarang anti Islam, Suteki pun balik bertanya. “Saya yakin rezim sekarang tidak akan mau dijuluki sebagai rezim anti Islam bukan? Saya kira kalau itu dilakukan akan bunuh diri. Namun, perlu diingat bahwa ketika umat Islam yang menyatu dalam suatu perkumpulan Islam HTI tidak diizinkan mendakwahkan sebagian ajaran Islam, misalnya dalam hal ini adalah tentang khilafah, lalu bolehkah kita menyebut rezim yang melarang itu sebagai rezim yang anti Islam?” tanyanya retoris.
Pasalnya, menurut Suteki, persoalan khilafah adalah persoalan utama pencabutan BH HTI ini. Pertanyaannya, benarkah khilafah itu hanya ajaran HTI? “Menurut pendapat saya: bukan. Mengapa? Karena khilafah itu sistem pemerintahan Islam yang tertulis di kitab para ulama dan juga fikih,” bebernya.
Menurut Suteki, keempat madzab yang dianut dalam Islam juga meyakini wajibnya khilafah bagi umat Islam. Secara normatif-teoretis tidak ada masalah dalam hal ini. Persoalan muncul ketika bicara politik praktis karena adanya kecurigaan terhadap upaya untuk mengganti ideologi Pancasila dan NKRI. Benarkah begitu? Apakah khilafah harus dihadapkan dengan ideologi Pancasila?
“Khilafah itu sistem pemerintahan Islam, bukan ideologi. Jadi menghadapkan khilafah dengan ideologi Pancasila itu tidak apple to apple. Bila mau seimbang seharusnya menghadapkan khilafah dengan demokrasi,” ujarnya.
Ia juga menegaskan dakwah khilafah yang dilakukan HTI bukanlah tindakan radikalisme. “Karena dakwah itu tidak dilakukan dengan pemaksaan dan penggunaan kekerasan. Itu yang prinsip. Jadi ketika HTI yang kebetulan mengusung dan mendakwahkan ajaran Islam itu secara damai, mestinya tidak diperlakukan buruk karena dinilai terpapar radikalisme yang berakhir dengan pencabutan BH HTI secara sepihak karena penilaian itu tidak melalui due process of law sebagaimana dulu diatur dalam UU No. 17 Tahun 2013 tentang Ormas,” pungkasnya.[]
