Pimpinan DPR Tegaskan konten revisi UU Ormas tidak dibatasi

MUSTANIR.COM, Jakarta — Wakil Ketua DPR Taufik Kurniawan mengatakan konten revisi Undang-Undang Organisasi Kemasyarakatan hasil pengesahan Peraturan Pemerintah Pengganti UU nomor 2 tahun 2017, tidak bisa dibatasi pada kesepakatan informal yang diambil beberapa pihak.
“Proses revisi suatu UU tidak bisa dibatasi tertentu pada hal-hal yang sudah ditentukan dalam kaitan kesepakatan informal, sangat dinamis sekali,” kata Taufik di Gedung Nusantara III, Jakarta, Rabu.
Dia mengatakan meskipun tidak bisa dipungkiri ada keinginan beberapa pihak dilakukan revisi terbatas UU Ormas namun harus melihat perkembangan yang ada dalam dinamika pembahasan UU Ormas.
Taufik memperkirakan pembahasan revisi UU Ormas akan dinamis karena tidak mungkin fraksi yang tidak setuju, tidak dilibatkan dalam pembahasannya.
“Karena ini sudah pembahasan perubahan Prolegnas, hanya saja pembahasannya nanti menunggu dari proses secara bersama dari setiap Daftar Inventarisir Masalah tiap fraksi,” katanya.
Taufik mengapresiasi sudah ada fraksi yang mengajukan naskah akademik dan draf revisi UU Ormas namun secara kolektif akan dibahas secara bersama-sama dengan fraksi lain.
Menurut dia partai yang mengajukan naskah akademik tersebut intinya mengawali revisi dan penyampaian klasterisasi dalam kaitan dengan fraksi-fraksi yang lain pasti menunggu bersama-sama pada saat akan di bahas.
“Kalau salah satu partai sudah menyampaikan naskah akademik revisi UU Ormas, proses pembahasannya disetujui masuk di perubahan Prolegnas pasti secara bersama-sama,” katanya.
Sebelumnya, PPP dan Partai Demokrat sudah menyatakan sikapnya akan mengajukan revisi UU Ormas hasil pengesahan Peraturan Pemerintah Pengganti UU nomor 2 tahun 2017.
Ketua Umum DPP Partai Demokrat Susilo Bambang Yudhoyono mengatakan ada tiga poin dalam UU Organisasi Kemasyarakatan hasil disetujuinya Peraturan Pemerintah Pengganti UU nomor 2 tahun 2017 yang harus direvisi dan partainya sudah mempersiapkan naskah akademiknya.
“Pertama, terkait bagaimana sanksi yang diberikan negara kepada ormas yang bertentangan dengan Pancasila. Termasuk siapa yang menafsirkan ormas A dan B bertentangan dengan Pancasila,” kata Susilo Bambang Yudhoyono (SBY) dalam konferensi pers di Kantor DPP Partai Demokrat, Jakarta, Senin (30/10).
Dia mengatakan Demokrat mengingatkan bahwa tidak boleh ormas dinilai bertentangsn dengan Pancasila kalau sifatnya hanya politis dan bukan berdasarkan hukum.
Kedua, menurut dia, mengenai pasal terkait tingkat ancaman hukuman dan siapa yang dikenakan hukuman, karena harus diberikan secara adil dan tidak boleh melampaui batas.
Poin ketiga, menurut dia, mengenai pasal pembubaran ormas, apabila negara dalam keadaan genting dan memaksa bisa membekukan ormas namun kalau pembubaran permanen tetap dalam proses hukum yang akuntabel.
Wakil Sekjen PPP Achmad Baidowi mengatakan partainya akan mengajukan usul inisitif revisi Undang Undang Organisasi Kemasyarakatan hasil pengesahan Peraturan Pemerintah Pengganti UU Nomor 2 Tahun 2017 untuk memperbaiki kekurangan dalam UU tersebut.
“PPP akan mengajukan usulan revisi terhadap UU Ormas, menjadi usul inisiatif DPR dan dimasukkan dalam Program Legislasi Nasional 2018 pada masa sidang pertama,” kata Achmad Baidowi, di Jakarta, Minggu (29/10).
Menurut dia, ada sejumlah hal yang masih bisa diperdebatkan dalam UU Ormas, antara lain peran pengadilan karena jangan sampai peran pengadilan dihapuskan dari UU Ormas.
Dia mengatakan walaupun asas hukum administrasi pemerintahan berlaku, kalau tidak dieksplisitkan dalam norma UU, maka dikhawatirkan akan menjadi pasal karet. (antaranews.com/1/11/2017)
