MA Dinilai Tidak Berpihak Pada Kebenaran Materiil Saat Tolak Kasasi HTI
MUSTANIR.com. – Tolak kasasi Hizbut Tahrir Indonesia terkait dicabutnya Badan Hukum Perkumpulan (BHP) HTI secara sepihak oleh pemerintah, Mahkamah Agung dinilai tidak berpihak kepada kebenaran materiil.
“Putusan MA itu tidak berpihak kepada kita, tidak berpihak kepada kebenaran materiil,” ujar Pakar Hukum Pidana Dr. Abdul Choir Ramadhan, S.H., M.H. Sabtu (23/2).
Karena, lanjutnya, keputusan pemerintah membubarkan BHP HTI itu jelas bertentangan dengan hukum. Dan itu telah nyata tidak ada proses hukum apa pun guna membuktikan bahwa HTI secara faktual, secara hukum, ingin mengubah UUD 1945 dan Pancasila. “Itu semua belum pernah dibuktikan di pengadilan!” tegasnya.
Menurut Abdul Choir, apabila itu belum dibuktikan, kemudian keputusan pemerintah itu menegasikan aturan hukum, tentu ini adalah suatu hal yang bertentangan dengan rule of law, bertentangan dengan proses hukum. “Kemudian BHP HTI dibubarkan tanpa didahului proses-proses hukum yang saya sebutkan itu,” ungkapnya.
Tentu ini menciderai keadilan hukum. “Saya berharap langkah hukum berikutnya adalah peninjauan kembali (PK). Dengan adanya PK, hakim PK membatalkan semua keputusan di bawahnya,” harap Ketua Umum Habib Rizieq Shihab (HRS) Center tersebut.
Dalam kasus-kasus lainnya pun dia menilai penegakan hukum termasuk yang dilakukan kepolisian dan kejaksaan belum berpihak pada keadilan. “Secara keseluruhan, penegakan hukum di era Jokowi ini belum berpihak kepada keadilan,” pungkasnya.[]
