Mengenal Kitab Kitab Fiqih Madzhab Maliki (2)

Mari kita berjalan-jalan sejenak ke negeri Spanyol pertengahan abad ke-4 dan 5 Hijriyah, tepatnya ke kota Kordoba. Kota tempat kelahiran Ibnu Abdil Barr, salah satu ulama’ dari madzhab Maliki yang mengarang Kitab yang sedang kita bahas kali ini, yaitu kitab Al-Istidzkar, yang merupakan salah satu Syarah dari kitab Al-Muwattha’ karya Imam Malik.

Kitab Al-Muwattha’ sendiri adalah salah satu kitab yang menjadi rujukan utama dari madzhab Maliki. Kitab ini cukup fenomenal pada masanya, bahkan Imam Syafi’i memuji kitab ini setinggi langit dengan berkata, “Tidak ada di muka bumi ini kitab yang lebih shahih (setelah kitabullah) selain kitab Al-Muwattha’.”

Selain merupakan kitab hadits, Al-Muwattha’ juga merupakan kitab fiqih. Hal ini bisa dilihat dari susunan hadits-hadits tersebut yang didasarkan pada bab-bab fiqih. Selain itu banyak pendapat-pendapat Imam Malik mengenai hukum-hukum fiqih yang beliau simpulkan dari hadits-hadits yang ada di kitab ini.

SYARAH-SYARAH DARI KITAB AL-MUWATTHA’

Atas apa yang disebutkan di atas, maka banyak ulama’-ulama’ dari madzhab Maliki yang membuat syarah dari kitab ini, di antaranya adalah Al-Mâlik karya Abu Bakar bin Sâbiq As-Saqhliy, Al-Muqtabis karya Abu Muhammad bin As-Sa’îd Al-Bathlayûsi, Al-Qabs karya Al-Qâdli Abu Bakar Ibn Al-‘Arabiy, Al-Muntaqâ, Al-Imâ’ dan Al-Istîfâ’, ketiganya adalah karya Abu Al-Walîd Al-Bâji.

Dan kitab yang sedang kita bahas kali ini adalah salah satu Syarahnya yaitu Al-Istidzkâr karangan Ibnu Abdil Barr. Selain Al-Istidzkar Ibnu Abdil Barr juga memiliki karya lain yang menjadi Syarah Al-Muwattha’ yaitu At-Tamhîd fî Al-Muwatthâ’ min Al-Ma’âniy wa Al-Asânîd.

TAHQIQ KITAB

Nama lengkap kitab ini cukup panjang, yang secara tidak langsung menjelaskan isinya, yaitu :

“الاستذكار الجامع المذاهب الأمصار وعلماء الأقطار فيما تضمنه الموطأ من معاني الرأي والآثار وشرح ذلك كله بالإيجاز والاختصار”

Kitab ini ditahqiq oleh dua orang Ulama’ yaitu Sâlim Muhammad ‘Athâ dan Muhammad Ali Mu’awwadl.

Yang dilakukan oleh tim pentahqiq terhadap kitab ini meliputi :

  1. Mentakhrij ayat-ayat Al-Qur’an dengan bersandar pada kitab Al-Mu’jam Al-Mufahras li Alfâdl Al-Qur’ân Al-Karîm.
  2. Mentakhrij hadits-hadits Nabi maupun atsar-atsar sahabat dan tabi’in yang bersandar pada kitab-kitab shahih maupun musnad.
  3. Mentakhrij syahid-syahid sya’ir dan menyandarkan pada sumber aslinya.
  4. Menjelaskan sebagian besar lafadh dan istilah yang memerlukan definisi, baik istilah bahasa maupun istilah dalam ilmu hadits dengan bersandar kepada kamus-kamus bahasa primer maupun kitab-kitab ilmu hadits seperti An-Nihâyah karya Ibnu Atsir maupun Al-Fâiq fî Gharîb Al-Hadîts karya Az-Zamakhsyari.

SEBAB PENULISAN KITAB

Kitab ini ditulis setelah penulisan kitab At-Tamhîd, hal yang melatar belakangi Imam Ibnu Abdil Barr menulis kitab ini adalah atas dasar permintaan para sahabat dan murid beliau.

Dalam Muqaddimah kitab beliau menjelaskan menjelaskan mengenai sebab penulisan kitab Al-Istidzkar ini :

“Ada sekelompok para penuntut Ilmu dari kalangan madzhab Maliki yang dalam beberapa kesempatan, baik secara lisan maupun secara tulisan (dari ulama’ di negeri yang jauh) agar aku menyusun kembali kitab At-Tamhîd berdasarkan urutan-urutan bab yang ada dalam Al-Muwattha’.

Mereka juga memintaku untuk menghapus pengulangan syahid hadits dan jalan-jalannya. Selain itu mereka juga memintaku untuk menyampaikan kepada mereka hadits musnad maupun mursal yang telah aku jelaskan, khususnya dalam kitab At-Tamhîd dengan menyebutkan perkataan para sahabat, tabi’in dan pendapat-pendapat yang mu’tamad dalam madzhab Maliki”.

Mereka juga memintaku untuk memilih pendapat para ulama’ salaf yang bisa dijadikan hujjah untuk generasi berikutnya dan menyebutkan pendapat dan perbedaan pendapat antara ulama amshar dalam makna hadits-hadits tadi. Itu semua dengan harapan agar syarah Muwattha’ menjadi lebih sempurna dan mendalam. Dengan syarat simple, ringkas dan menghilangkan syahid-syahid yang berulang seperti yang terdapat dalam kitab At-Tamhîd.”

HUBUNGAN ANTARA AL-ISTIDZKAR DENGAN AT-TAMHID

Sebagaimana dijelaskan di atas, kitab ini sebenarnya merupakan kitab ringkasan dari kitab At-Tamhid yang beliau tata ulang. Perbedaan pokok antara kedua kitab ini adalah pada kita At-Tamhid penulis menyusun dan mengurutkan babnya berdasarkan nama Syaikh perawi hadits, sedangkan Al-Istidzkar disusun berdasarkan susunan bab Fiqih seperti pada Al-Muwattha’.

Dengan demikian pada At-Tamhid tidak ditemukan kesatuan pembahasan bab fiqih. Artinya bisa saja suatu permasalahan fiqih yang sudah dibahas pada bab tertentu diulangi kembali pembahasannya pada bab yang lain. Sebab, bisa saja Imam Malik meriwayatkan hadits-hadits yang berkaitan dengan satu permasalahan dari beberapa Syaikh yang berbeda:

  • Dalam Al-Istidzkar beliau secara langsung menyebutkan riwayat-riwayat para Fuqaha’ amshar dan Ulama’ Aqthâr dalam permasalahan tertentu, tanpa menyebutkan sanadnya. Sebab beliau sudah menyebutkannya dalam kitab At-Tamhîd, untuk itu beliau mengarahkan kepada para pembaca untuk merujuk ke sana, ketika ingin mengetahui secara lengkap sanadnya.
  • Kitab al-Istidzkar lebih memperhatikan penjelasan dari hadits-hadits dalam Al-Muwattha’ tanpa memaparkan secara detail biografi para perawinya, kecuali perawi yang belum disebutkan biografinya pada kitab At-Tamhid. Berbeda dengan At-Tamhîd yang dipaparkan secara lengkap.
  • Dalam Al-Istidzkar juga tidak disebutkan hal-hal yang berkaitan dengan ilmu-ilmu musthalah hadits maupun keutamaan imam Malik, sebab telah disebutkan dalam At-Tamhid

ISI KITAB

Kitab Al-Istidzkar terdiri dari 9 jilid, satu jilid terdiri dari beberapa pembahasan besar (Kitab), dan dalam satu kitab terdapat beberapa Bab, berikut ini gambaran lengkapnya :

  • Jilid 1 , terdiri dari 3 kitab, yaitu : Waktu Shalat, Thaharah, Shalat
  • Jilid 2, terdiri dari 12 kitab, yaitu : Sujud Sahwi, Shalat Jum’at, Shalat pada Bulan Ramadhan, Shalat Malam, Shalat Jama’ah, Mengasar Shalat dalam perjalanan, Dua Hari Raya, Shalat Khauf, Shalat Kusuf, Shalat Istisqa’, Qiblat, Al-Qur’an.
  • Jilid 3, terdiri dari 5 kitab, yaitu : Jenazah, Zakat, Shadaqah, Puasa, I’tikaf.
  • Jilid 4, terdiri dari 2 kitab, yaitu : Haji (Bagian pertama), Haji (Bagian kedua)
  • Jilid 5, terdiri dari 7 kitab, yaitu : Jihad, Sembelihan Idul Adha, Sembelihan (Umum), Binatang Buruan, Aqiqah, Faraidh, Nikah
  • Jilid 6, terdiri dari 3 kitab, yaitu : Thalaq, Radla’ah, Jual Beli
  • Jilid 7, terdiri dari 9 kitab, yaitu : Al-Qardhu (Hutang piutang), Musâqqah, Menyewakan Tanah, Syuf’ah, Qadla’, Wasiat, Al-Itqu wa Ar-Raqabah, Mukâtab, Al-Mudabbar (tiga bab ini berkaitan dengan masalah budak), Hudûd
  • Jilid 8, terdiri dari 19 kitab, yaitu : Minuman, Al-Uqûl (Diyat), Qasâmah, Al-Jâmi’, Al-Qadar, Akhlaq Baik, Pakaian, Sifat Nabi, Penyakit ‘Ain, Permasalahan Rambut, Mimpi, Perjanjian Damai, Meminta Izin, Bai’at, Adab berbicara, Neraka Jahannam, Ilmu, Do’a orang yang terdhalimi dan Nama-nama Nabi.
  • Jilid 9, jilid ini berisi kumpulan indeks kumpulan daftar isi dari jilid-jilid sebelumnya di antaranya : Indeks ayat-ayat Al-Qur’an, indeks hadits-hadits Nabi, baik yang di Muwattha’ maupun Al-Istidzkar, Indeks Atsar Shahabat, baik yang di Muwattha’ maupun di Al-Istidzkar, Indeks Para Syaikh Imam Malik, Indeks para Syaikh Ibnu Abdil Barr, Daftar Perawi Hadits Muwattha’, Indeks perawi hadits Al-Istidzkar, Daftar permasalan fiqih penting, Indeks bait-bait sya’ir, dan Daftar Isi Pembahasan kitab.

METODE PENULISAN KITAB

Kitab Al-Istidzkar bisa digolongkan sebab kitab fiqih perbandingan madzhab, karena dalam mensyarah hadits-hadits dalam kitab ini beliau tidak hanya menyebutkan pendapat dari madzhab Maliki saja melainkan juga dari madzhab lain seperti Hanafi, Syafi’i dan Hanbali. Berikut ini adalah beberapa metode yang dipakai oleh Ibnu Abdil Barr dalam menulis kitabnya :

Pertama, beliau menyebutkan hadits dari Muwattha’, setelah itu Ibnu Abdil Barr memberikan syarah dari hadits tersebut baik dari sisi derajat hadits maupun perkataan ulama tentang hadits tersebut. Metode dalam menjelaskan hadits-hadits yang ada terkadang dengan cara menyebutkan semua hadits yang berkaitan dengan bab fiqih yang sedang dibahas, baru kemudian menjelaskannya, atau dengan menjelaskan hadits satu per satu, namun masih dalam satu tema dan pembahasan.

Setelah itu beliau menyebutkan perkataan-perkataan ulama’ dalam permasalahan fiqih yang berkaitan dengan hadits tersebut. Dalam memaparkan pendapat para ulama’ beliau menjelaskannya langsung ke inti pendapat, dengan harapan bisa lebih mudah untuk dipahami dan dihafalakan.

Permasalahan-permasalahan fiqih merupakan porsi pembahasan utama dalam kitab ini, beliau menyebutkan banyak adu argument, pengertian-pengertian maupun metode dalam mengambil kesimpulan dari dalil yang ada. Ini adalah yang menjadi keistimewaan kitab Al-Istidzkar, di mana kesamaan tema fiqih merupakan patokan utama dalam kitab ini.

Riwayat Muwattha’ yang dipakai oleh Ibnu Abdil Baarr dalam kitab ini adalah riwayat dari jalur Yahya bin Yahya Al-Andalusi. Jalur periwayatan Ibnu Abdil Barr sampai ke Imam Malik adalah sebagai berikut : dari Abu Utsman Sa’id bin Nashr, dia meriwayatkan dari Muhammad Qasim bin Asbagh dan Wahab bin Masarrah, keduanya meriwayatkan dari Ibnu Waddlâh dari Yahya bin Yahya dari Imam Malik bin Anas.

BIOGRAFI PENULIS

Setelah kita mengetahui gambaran isi kitab dan metode penulisannya maka alangkah baiknya jika kita juga mengenal penulis kitab, yaitu Ibnu ‘Abdil Barr. Berikut penjelasannya :

Nama Lengkap

Nama lengkap beliau adalah Abu ‘Umar Yusuf bin Abdillah bin Muhammad bin Abdil Barr, An-Namriy Al-Quthubiy, Al-Faqîh Al-Maliki. Beliau dijuluki Hâfidh Al-Maghrib dan seorang Imam Ahli hadits di masanya.

Lahir dan Perjalanan Hidupnya

Beliau dilahirkan pada bulan Rabi’ul Akhir tahun 368 H di kota Kordoba. kemudian belajar dari lebih dari seratus ulama dan mendapatkan ijazah dari mereka untuk menyampaikan apa yang beliau dapatkan dari Syaikhnya.

Beliau tinggal di wilayah Barat Andalus kemudian berkelana ke wilayah timur Andalus. Beliau sempat menetap di beberapa kota dan juga sempat memegang jabatan sebagai Qadli di dua kota di wilayah tersebut.

Kapasitas Keilmuannya

Kapasitas keilmuan beliau adalah sebagai salah satu Imam hafidh Hadits, sejarawan, Sastrawan dan menjabat sebagai Qadli.

Beliau adalah orang yang tsiqah, memikili pemahaman yang sangat luas baik dalam ilmu fiqih, bahasa Arab, Hadits dan Sejarah, selain itu beliau juga memiliki keahlian di bidang ilmu nasab.

Ibnu Abdil Barr mendapatkan penghormatan dan pujian dari para ulama yang hidup semasa dengannya.

Pujian Para Ulama :

Abu Abdillah bin Abil Fath : Abu Umar adalah orang yang paling pandai di Andalus dan paling memahami ilmu Sunnah, Atsar dan Perbedaan pendapat ulama’ hadits.”

Imam Adz-Dazhabi : “Dia adalah seorang Imam yang Bergama kuat, tsiqah, mutqin, allamah, sangat mendal ilmunya. Dia adalah seorang pengikut sunnah, dan sampai pada derajat imam Mujtahid.”

As-Suyûthi : “Ibnu Abdil Barr memimpin masanya dengan hafalan dan ketelitiannya, dia sampai pada derajat imam Mujtahid.”

Ibnul Bâjî : “di Wilayah Andalus ini tidak ada orang yang menyamai Ibnu Abdil Barr dalam ilmu hadits, dia adalah Hafidh terbaik wilayah Maghrib.Yusuf bin Abdillah bin Abi Zaid bin Ibâd dari Almeria mengarang kitab berjudul “Tingkatan Ahli Fiqih pada masa Ibnu Abdil Barr.”

Wafatnya :

Ibnu Abdil Barr wafat pada bulan Rabi’ul Akhir tahun 463 H pada usia 95 tahun.

Karya-karyanya :

Karya Ibnu Abdil Barr mencapai 57 kitab di beberapa disiplin keilmuan seperti ilmu qira’at, hadits, fiqih, sejarah, bahkan ilmu nasab. di antaranya :

1. Albayân ‘an tilâwah Al-Qur’ân

2. Al-Iktifâ’ fi qirâ’ati Nâfi’ wa Abî Umar Ibn Al-‘Allâ’ bitaujîhi ma Ikhtalafa fîhi

3. At-Taqasshiy lima fî Al-Muwatthâ’ min Hadîtsi Ar-Rasûl

4. As-Syawâhid fî Itsbâti Khabar Al-Wâhid
