Demokrasi Membangkitkan Kaum Luth

Di kala umat Islam diseluruh dunia menghormati bulan suci Ramadhan dengan berbagai ibadah yang diperintahkan Allah SWT, sembari terus menerus meningkatkan keimanan dan ketakwaannya. Kabar kontroversial datang dari negara kampium Demokrasi, Amerika Serikat. Negara berpenduduk 320 juta lebih itu akhirnya melegalkan pernikahan sesama jenis (same-sex marriage) di seluruh negara bagiannya melalui keputusan Mahkamah Agung AS pada Jumat 26 Juni 2015 waktu setempat.
Presiden AS Barack Obama pun memuji keputusan ini, “Today is a big step in our march toward equality. Gay and lesbian couples now have the right to marry, just like anyone else.” (Hari ini kita mengambil langkah besar di dalam perjuangan mencapai kesetaraan. Pasangan gay dan lesbian sekarang memiliki hak untuk menikah seperti siapa pun) kata Obama. (twitter.com, 26/6/2015).
Dukungan serupa muncul dari calon presiden AS Partai Demokrat, Hillary Clinton. “Proud to celebrate a historic victory for marriage equality—& the courage & determination of LGBT Americans who made it possible.” (Saya bangga dapat ikut merayakan kemenangan bersejarah demi mencapai kesetaraan pernikahan ini –& keberanian serta tekad warga LGBT Amerika-lah yang membuat hal demikian menjadi mungkin) kata Hillary. (twitter.com, 26/6/2015).
Dilegalkannya pernikahan sesama jenis di AS, sebenarnya berbanding lurus dengan kondisi objektif masyarakat AS itu sendiri, yang beberapa tahun ini memang menunjukan dukungan yang tinggi terhadap LGBT (lesbian, gay, biseksual, dan transgender).
Tengok saja misalnya, survei Pew Research Center yang dirilis Maret 2014, menyatakan bahwa 54 % warga AS mendukung pernikahan sesama jenis, hanya 39 % yang menolak, dan sisa 7 % tidak tahu. (pewresearch.org, 7/3/2014). Tren ini semakin meningkat hingga 63 % pada tahun 2015 sebagaimana dirilisCNN/ORC International pada Februari kemarin. (cnn.com, 19/2/2015).
AS tentunya bukan negara Barat pertama yang mengesahkan hukum kontroversial ini. Menurut laporan washingtonpost.com(26/6/2015), ada lebih dari 20 negara yang melegalkan hal tersebut, diantaranya: Belanda (2001), Belgia (2003), Kanada (2005), Spanyol (2005), Afrika Selatan (2006), Norwegia (2009), Swedia (2009), Portugal (2010), Argentina (2010), Islandia (2010), Denmark (2012), Brazil (2013), Inggris (2013), Prancis (2013), Selandia Baru (2013), Uruguay (2013), Luxemburg (2014), Skotlandia (2014), Finlandia (2015), Slovenia (2015), Irlandia (2015), dan Meksiko (2015).
Peristiwa legalisasi pernikahan sesama jenis di AS dan negara Barat lainnya, sejatinya menunjukan kepada dunia secara pasti betapa rusaknya masyarakat yang dibangun dengan tatanan Demokrasi. Dengan mekanisme demokratis pelaku LGBT bisa bebas dan menyebarkan virusnya. Maka tak berlebihan jika kita sebut bahwa demokrasi telah membangkitkan kaum Luth modern.
Awas Kampanye Barat
Sebenarnya Amerika sendiri sebagai negara Demokrasi, sudah sejak lama melakukan kampanye mendukung LGBT, hal ini dimulai sejak Januari 2009, ketika HIllary Clinton masih menjadi menlu, dia mengarahkan Departemen Luar Negeri AS agar mendukung penuh diciptakannya sebuah agenda HAM yang komprehensif, yakni agenda yang meliputi perlindungan terhadap kaum LGBT. Deplu AS menggunakan segala perangkat diplomatik dan berbagai fasilitas bantuan pembangunannya untuk mendorong dihapuskannya kekerasan dan diskriminasi terhadap kaum LGBT di seluruh dunia. (www.state.gov, 6/12/2011).
Sesuai dengan visi Menlu Clinton kala itu, Kedutaan Besar AS di Jakarta pun sejak 2011 telah berusaha mengintegrasikan hak-hak kaum LGBT melalui beragam upaya untuk mendukung HAM di Indonesia. (indonesian.jakarta.usembassy.gov, 15/05/12).
Karena itu bisa dikatakan, legalisasi pernikahan sesama jenis di AS, merupakan momentum propaganda Barat dalam memperkokoh tatanan Demokrasi dan menyebarkan kebebasan (liberalisme) di seluruh dunia, termasuk Indonesia. Maka jangan heran, jika setelah ini akan semakin bermunculan propaganda besar-besaran dukungan terhadap LGBT di negeri muslim terbesar ini. Hingga akhir tahun 2013 saja, terdapat dua jaringan nasional organisasi LGBT yang terdiri dari 119 organisasi berlokasi di 28 provinsi dari 34 provinsi di Indonesia (Lihat: Hidup Sebagai LGBT di Asia: Laporan Nasional Indonesia, UNDP. www.id.undp.org, 2014: 57).
Pelaku LGBT beserta para pendukungnya bisa bergerak bebas dan menyebarkan pikiran tak beradab tersebut, justru tentunya setelah mendapat justifkasi dari ide liberalisme, berupa kebebasan berekspresi dan berperilaku; berdasarkan ideologi sekuler yang menafikan agama dari kehidupan. Hal ini dilegitimasi juga oleh ide HAM, dan dilestarikan negara Demokrasi. Jadi, selama Indonesia menerapkan Demokrasi, maka ancaman propaganda LGBT akan terus menusuk sendi-sendi kehidupan umat Islam di Indonesia.
Islam adalah Penyelamat
DALAM negara yang menerapkan Islam, tentu tidak akan ditemui masyarakat yang mendukung apalagi menjadi pelaku LGBT secara massif, sebagaimana yang ada di negara-negara Barat. Oleh karena itu, memberantas perilaku LGBT haruslah dilakukan dari akarnya dengan membuang ideologi sekuler berikut paham liberalisme, politik demokrasi dan sistem kapitalisme. Hal itu diiringi dengan penerapan ideologi Islam dengan syariahnya secara total.
Untuk melindungi masyarakat dari perilaku LGBT, Islam memiliki solusi jitu sebagai berikut:
Pertama, secara preventif, Islam mewajibkan negara untuk terus membina keimanan dan memupuk ketakwaan rakyat. Agar menjadi kendali diri dan benteng yang menghalangi muslim terjerumus perilaku LGBT. Islam pun dengan tegas menyebut perilaku LGBT merupakan dosa dan kejahatan yang besar di sisi Allah swt. Sebagaimana kejahatan homoseksual oleh kaum Sodom (perilakunya disebut sodomi) kaum nabi Luth, yang Allah binasakan mereka hingga tak tersisa.
Kedua, Islam memerintahkan untuk menguatkan identitas diri sebagai laki-laki dan perempuan. Karena itu, Islam mengatur agar masing-masing fitrah yang ada tetap terjaga; laki-laki memiliki kepribadian maskulin, dan perempuan memiliki kepribadian feminin; wanita tidak boleh menyerupai laki-laki, begitu juga sebaliknya. Dari Ibnu Abbas ra: “Nabi saw melaknat laki-laki yang berlagak wanita dan wanita yang berlagak meniru laki-laki.” (HR. al-Bukhari, 5436).
Pola asuh orang tua dan kondisi yang diberikan kepada anak pun harus menjamin hal itu. Maka, sejak dini anak-anak harus dipisahkan tempat tidur mereka. Rasul bersabda (artinya): “Suruhlah anak-anakmu shalat pada usia 7 tahun, pukullah mereka (jika meninggalkan shalat) pada usia 10 tahun, dan pisahkan mereka di tempat tidur.” (HR. Abu Dawud, 418).
Dalam pergaulan antara jenis dan sesama jenis pun harus terjaga. Rasul bersabda (artinya): “Janganlah seorang laki-laki melihat aurat laki-laki. Jangan pula perempuan melihat aurat perempuan. Janganlah seorang laki-laki tidur dengan laki-laki dalam satu selimut. Jangan pula perempuan tidur dengan perempuan dalam satu selimut.” (HR. Muslim, 512).
Ketiga, secara sistemik, negara dalam Islam harus menghilangkan rangsangan seksual dari publik termasuk pornografi dan pornoaksi. Begitu pula segala bentuk tayangan dan sejenisnya yang menampilkan perilaku LGBT atau mendekati ke arah itu juga akan dihilangkan.
Keempat, permudah pernikahan. Sebab, tak jarang LGBT terjadi karena pelaku kecewa dengan kondisi yang ada, karena sulitnya menyalurkan naluri dengan halal, akhirnya mereka terjerumus dalam perilaku LGBT. Negara juga wajib memfasilitasi. Bukan malah mempersulit nikah usia muda. Sebab dalam syariah pernikahan dini tidak masalah, asal sesuai syariat.
Kelima, penegakkan sanksi bagi para pelaku LGBT. Sehingga para pelaku juga jera dan berpikir ulang jika mau melakukan LGBT. Ini semua demi menjaga masyarakat agar tetap dalam kondisi yang sejalan dengan frame peradaban Islam. Berikut sanksi bagi LGBT:
(1) Ijma’ sahabat menyatakan bahwa hukuman bagi pelaku homoseksual (gay) adalah hukuman mati, baik sudah menikah atau belum, meski diantara para sahabat berbeda pendapat tentang teknis eksekusi hukuman mati itu. (al-Maliki, Nizham al-’Uqubat, Bab Hadd al-Liwath). Rasul saw bersabda (artinya): “Siapa saja yang kalian temukan melakukan perbuatan kaum Luth (homoseksual) maka bunuhlah pelaku (yang menyodomi) dan pasangannya (yang disodomi).” (HR. Abu Dawud 3869; at-Tirmidzi 1376, bn Majah 2551, Ahmad 2596).
(2) Lesbianisme berbeda dengan liwath (homoseksual). Lesbianisme (at-tadaluk, as-sahaq, atau al-musahaqah) adalah hubungan seksual yang terjadi di antara sesama wanita. Mirip dengan zina hanya saja tidak terjadi penetrasi. Semua fuqaha sepakat hukuman lesbianisme bukan zina, melainkan ta’zir, yaitu hukuman yang tidak ditentukan secara khusus oleh syara’. Dalam hal ini bentuk dan kadarnya ditentukan hakim (Qadhi), seperti dicambuk, dipenjara, dll. (Shiddiq al Jawi, hizbut-tahrir.or.id, 16/5/2012).
(3) Biseksual itu tergolong zina ketika dilakukan dengan lain jenis. Jika dilakukan dengan sesama jenis, maka tergolong homoseksual jika dilakukan sesama laki-laki; dan tergolong lesbianisme jika dilakukan sesama wanita. Hukumnya sesuai fakta. Jika tergolong zina, hukumnya rajam (dilempar batu sampai mati) jika pelakunya muhshan (sudah menikah) dan dicambuk seratus kali jika pelakunya bukan muhshan. Jika tergolong homoseksual, dihukum mati. Jika tergolong lesbianisne, di-ta’zir. (Shiddiq al Jawi, al-khilafah.org, 12/18/2010).
(4) Sedangkan transgender adalah perbuatan menyerupai lain jenis. Baik dalam berbicara, berbusana, maupun dalam berbuat, termasuk dalam aktivitas seksual. Islam mengharamkan perbuatan menyerupai lain jenis. Sanksinya, jika sekedar berbicara/berbusana menyerupai lawan jenis, diusir dari pemukiman atau perkampungan. Nabi saw bersabda (artinya), “Usirlah mereka dari rumah-rumah kalian.” Maka Nabi Shallawllahualaihi Wasallam pernah mengusir Fulan dan Umar ra juga pernah mengusir Fulan. (HR. Bukhari no 5436).
Jika transgender berhubungan seksual, maka sanksi sesuai faktanya. Jika terjadi di antara sesama laki-laki, maka dijatuhi sanksi homoseksual. Jika terjadi di antara sesama wanita, dijatuhi sanksi lesbianisme. Jika terjadi dengan lain jenis, dijatuhi sanksi zina. Memang dalam Islam dikenal istilah khuntsa atau hermaphrodit, yakni orang yang mempunyai kelamin ganda. Mereka memang diakui dalam fiqih Islam. Namun ini sama sekali berbeda dengan transgender, karena kaum transgender mempunyai kelamin yang sempurna, bukan kelamin ganda, hanya saja mereka berperilaku menyerupai lawan jenisnya. (ibid).
Berdasarkan aturan Islam tersebut, kehidupan umat akan dipenuhi oleh kesopanan, keluhuran, kehormatan, martabat dan ketenteraman dan kesejahteraan. Itu semua hanya terwujud jika syariah Islam diterapkan secara total di bawah sistem khilafah ala minhaj nubuwwah. Sekarang Khilafah sudah tidak ada sejak keruntuhannya di Turki 1924. Maka artinya umat wajib berjuang mengembalikan Khilafah ala minhaj nubuwwah di muka bumi sekali lagi. Khilafah-lah yang akan menjalankan Syariah Islam secara kaffah, termasuk menjatuhkan sanksi yang tegas terhadap pribadi-pribadi hina yang melakukan lesbianisme, gay, biseksual, dan transgender. Rasul saw bersabda (artinya): “Menegakkan hukuman (hadd) di bumi lebih baik bagi penduduknya daripada hujan selama empat puluh malam.” (HR. An-Nasa’I, 4821). Wallahu a’lam. []
